1. Acceptance of Terms
By joining the Duet Inc. Affiliate Program, you agree to be bound by these Terms of Service (the "Agreement"), as well as our Privacy Policy and any other applicable policies.
2. Enrollment in the Affiliate Program
To begin the enrollment process, you must submit a complete program application through our website. We reserve the right to accept or reject your application at our sole discretion for any reason.
3. Obligations of the Parties
Subject to our acceptance of you as an affiliate and your continued compliance with the terms and conditions of this Agreement, Duet Inc. agrees to pay you an affiliate commission for referral sales made to customers who purchase products using your affiliate link.
4. Affiliate Responsibilities
4.1 You agree to use the Affiliate Program in a manner that is ethical and in compliance with all applicable laws and regulations.
4.2 You are responsible for ensuring that all materials posted on your site are not illegal or offensive and do not infringe upon the intellectual property rights of any third party.
4.3 You may not create or design your website or any other website that you operate, explicitly or implied, in a manner that resembles our website nor design your website in a manner that leads customers to believe you are Duet Inc. or any other affiliated business.
5. Prohibited Activities
5.1 You are expressly prohibited from using any persons, means, devices, or arrangements to commit fraud, violate any applicable law, interfere with other affiliates or falsify information in connection with referrals through the links or the generation of commissions or exceed your permitted access to the Affiliate Program.
5.2 Advertising on Branded Keywords: Affiliates are not permitted to bid on Duet Inc. branded keywords or any variations or misspellings thereof for search or content-based campaigns on Google, Bing, Yahoo, or any other network. This includes, but is not limited to, Duet Inc., [Your Company Website], and any other trademarks. Affiliates found to be engaging in such activities will be subject to immediate termination from the program and forfeiture of any outstanding commissions.
6. Commission and Payment
Duet Inc. will pay you a commission on sales referred by your site according to the commission schedule and payment terms disclosed to you upon your acceptance into the Affiliate Program. You will only receive a commission for qualified leads, which Duet, Inc. has sole discretion to determine.
7. Term and Termination
The term of this Agreement will begin upon our acceptance of your Affiliate Program application and will end when terminated by either party. Either you or Duet Inc. may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination.
8. Modification
We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but are not limited to, changes in the scope of available commissions, commission schedules, payment procedures, and Affiliate Program rules.
9. Limitation of Liability
Duet Inc. will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with this Agreement or the Affiliate Program. Furthermore, our aggregate liability arising with respect to this Agreement and the Affiliate Program will not exceed the total commissions paid or payable to you under this Agreement.
10. Miscellaneous
10.1 Governing Law: This Agreement shall be governed by and interpreted in accordance with the laws of [Your Jurisdiction] without regard to its rules on conflicts of law.
10.2 Independent Contractors: You and Duet Inc. are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Duet Inc.
